1.1 About Us
Traviator Adventures & Outdoors ("Traviator", "we", "us", "our") is a proprietorship engaged in organizing adventure travel experiences including treks, safaris, retreats, bike and car expeditions, backpacking group departures, corporate events, school programs, family trips, and domestic and international tours.
By booking, participating in, or using any of our services, you agree to be bound by these Terms & Conditions.
1.2 Booking & Confirmation
A booking is considered confirmed only after receipt of the required advance payment and issuance of a booking confirmation by Traviator.
Prices are quoted per person unless specified otherwise and are subject to availability.
Itineraries may be adjusted due to weather, road conditions, safety concerns, permit restrictions, or operational requirements.
1.3 Participant Eligibility & Responsibilities
Participants must meet minimum age, fitness, and experience requirements specific to each trip.
For bike and car expeditions, participants must hold a valid driving license and demonstrate adequate riding/driving capability.
Participants are responsible for disclosing accurate health, fitness, and medical information relevant to the activity.
Any willful misconduct, unsafe behavior, intoxication, or violation of local laws may result in removal from the trip without refund.
1.4 Safety & Adventure Risk
Adventure travel involves inherent risks including but not limited to altitude sickness, weather changes, wildlife encounters, road conditions, mechanical failures, and physical exertion.
By participating, you acknowledge that:
You understand the nature of the activity and associated risks.
You voluntarily assume responsibility for your participation.
Traviator’s role is limited to coordination and facilitation, not risk elimination.
1.5 Changes & Substitutions
Traviator reserves the right to change trip leaders, accommodation, transport, routes, or schedules when required for safety or operational reasons.
Such changes do not entitle participants to refunds unless expressly stated.
1.6 Force Majeure
Traviator shall not be liable for delays, modifications, or cancellations caused by events beyond reasonable control, including but not limited to:
Natural disasters, extreme weather
Landslides, road closures
Government orders, permit restrictions
Political unrest, strikes, pandemics
1.7 Limitation of Liability
Traviator shall not be responsible for loss of personal belongings, injury, illness, or death except where required by applicable law.
Participants are strongly advised to obtain adequate travel and medical insurance, including adventure activity coverage.
1.8 Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
2. Cancellation & Refund Policy
Cancellation charges vary based on the nature of the trip, advance commitments, permits, and logistics involved. All cancellations must be communicated in writing via email or WhatsApp.
2.1 Backpacking Group Trips (Domestic & International)
Designed for flexibility while accounting for group logistics:
More than 21 days before departure: Refund after deduction of a nominal processing fee
10–21 days before departure: 50% refund (after deducting non-refundable components)
5–9 days before departure: 25% refund
Less than 5 days / No-show / Early exit: No refund
Transfers to another Traviator backpacking departure may be allowed at Traviator’s discretion, subject to availability.
2.2 Bike Expeditions & Car Expeditions
Due to permits, vehicle logistics, and advance vendor commitments:
More than 30 days before departure: Refund after deducting processing and permit charges
15–30 days before departure: 40% refund
7–14 days before departure: 20% refund
Less than 7 days / No-show / Removed for safety or misconduct: No refund
Damage to rented bikes/vehicles or equipment is chargeable separately.
2.3 International Tours
International trips involve non-refundable airline tickets, visas, and overseas supplier payments:
More than 45 days before departure: Refund after deduction of visa, flight, and supplier charges
30–45 days before departure: 50% refund
15–29 days before departure: 25% refund
Less than 15 days / Visa rejection / No-show: No refund
Visa approval is subject to embassy discretion and is not guaranteed by Traviator.
2.4 Corporate Programs & School Trips
Custom-designed programs with fixed vendor commitments:
More than 30 days before program date: Refund after deducting confirmed vendor and planning costs
15–30 days before program date: 50% refund
7–14 days before program date: 25% refund
Less than 7 days / Participant dropouts / No-show: No refund
Participant substitutions may be allowed with prior written approval.
2.5 Non-Refundable Components (Applicable to All Trips)
The following are typically non-refundable once booked:
Permits and entry fees
Flights, trains, or special transport
Bike or car rentals and fuel advances
Accommodation booked under non-refundable terms
Third-party activity or adventure fees
2.6 Cancellation by Traviator
Traviator may cancel or reschedule a trip due to insufficient participation, safety concerns, regulatory restrictions, or force majeure events.
In such cases, participants may be offered:
A full or partial refund (after deducting irrecoverable costs), or
Credit or transfer to a future Traviator trip
2.7 Refund Processing
Approved refunds are processed within a reasonable time after deductions.
Refunds are issued via the original mode of payment where feasible.
3. Risk Acknowledgement & Disclaimer
3.1 Assumption of Risk
By participating in any Traviator experience, you acknowledge that adventure travel carries inherent and unpredictable risks. You voluntarily accept these risks and agree to participate at your own discretion.
3.2 Medical Fitness
Participants confirm that they are medically and physically fit for the chosen activity.
Traviator is not responsible for medical complications arising from undisclosed conditions.
3.3 Equipment & Rentals
Equipment provided or rented (including bikes and vehicles) must be used responsibly.
Participants are liable for damage caused due to negligence or misuse.
3.4 Photography & Media Consent
Unless opted out in writing prior to the trip, participants grant Traviator permission to use photographs and videos captured during trips for promotional and storytelling purposes.
3.5 Severability
If any provision of these policies is found unenforceable, the remaining provisions shall continue to be valid and enforceable.
